Terms of Use
These terms govern your use of the OpenEar app and this website. By buying a tour or using the app, you agree to them.
Who we are
OpenEar is operated by Lisya Dana Nahmiyas, a sole trader (autónomo) registered in Barcelona, Spain. Contact: [email protected].
What you're buying
Each tour is a piece of digital content: narrated audio, a route, and written transcripts. When you buy a tour, you get a personal, non-transferable licence to listen to it and read it, for as long as OpenEar operates. You don't buy the content itself, and you don't get the right to copy, share, broadcast, resell, or reuse it.
There is no subscription. You buy a tour once and it stays in your account.
Buying through Apple
Tours bought inside the iOS app are sold by Apple. Apple takes the payment, issues the receipt, and handles refunds. If you want a refund for an in-app purchase, you must request it from Apple — we cannot issue it for you. You can do that at reportaproblem.apple.com.
We may also sell tours through our website. Purchases made there are handled by our payment provider, and refund requests for those go to us.
Your right to withdraw (EU)
If you're in the EU, you normally have 14 days to withdraw from a purchase of digital content. That right ends once the content starts being delivered — which, for OpenEar, is the moment the tour unlocks in your account. By buying a tour, you ask us to make it available immediately and you accept that you lose the right to withdraw once we do.
This does not affect your rights if the content is faulty or not as described.
Your account
Buying a tour and restoring it require an account. This is so that a tour you bought stays yours across devices and platforms — including if you bought it on the web and want to listen on your phone.
You can delete your account at any time from the app. Deleting it removes your account and your access records from our systems. If you bought through Apple, your purchase still exists in your Apple account and you can claim it again by signing in and restoring — but we cannot guarantee this, because it depends on Apple.
Walking safely
OpenEar is a walking tour. You will be on real streets, with real traffic, wearing headphones.
You are responsible for your own safety. Watch where you are going. Obey traffic signals. Keep the volume low enough to hear what's around you. Do not use the app while driving or cycling. Routes are suggestions, not instructions, and we are not responsible for the condition of the streets, buildings, or areas you walk through.
If a route or a stop seems unsafe, stop walking it.
What we don't promise
We research and fact-check our tours carefully, but history is contested and places change. We don't guarantee that every detail is complete or current.
GPS is imperfect. Stops may trigger early, late, or not at all, depending on your device, your surroundings, and the weather. Download a tour before you walk it.
We don't guarantee that the app or the website will always be available or free of errors.
Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Beyond that, our liability to you is limited to the amount you paid for the tour in question.
Changes
We may change these terms. If we make a material change, we'll update the date at the top. Continuing to use OpenEar after a change means you accept it.
Governing law
These terms are governed by Spanish law. If you are a consumer, you keep the mandatory protections of the country you live in, and you can bring proceedings there.
